The Business of the Giant HOA Industy

Texas Monthly Report – Conflicts-and-Interests: “HOAs have become a big business. They generate $40 billion in annual assessment revenue (the dues collected from individual homeowners) and $35 billion in reserves, representing a huge government-like contracting opportunity — only without all the procurement safeguards and transparency guarantees expected of taxpayer-supported entities.”  “...management companies run the day-to-day operations for the boards. They enforce the deed restrictions, interact with the homeowners, operate the websites, hire the contractors (which may be a subsidiary of the management company), and, most important, control the money.”  


Case-in-point, First Service acquired San Antonio, TX based Association Management Services (AMS) founded by Barbara Lawry, who is the president and newest partner of First Service Residential Texas.


Barbara Lawry is regularly seen at the Texas Capitol - lobbying and testifying on behalf of the industry for laws to benefit its financial interests, to the determent of homeowners.


The industry’s lobbyist talking points are deceptively fine-tuned:  "Homeowners have choices.  If you don’t like your HOA, just move!” Or as Bluffview Greens HOA board repeatedly challenged, “if you don’t like the board, vote us off the board at the next annual meeting.” Obviously unrealistic challenges...

Two years ago, Bluffview Greens, a gated community in San Antonio, Texas elected a new unopposed board member as president. The Board then directed AMS / First Service Residential management attorney to file a new ‘governing document’ at the County Courthouse which conflicted with our original documents, and nullified previous board decisions. The document was filed on October 2, 2015. However the board did not vote to approve the document until October 7, 2015. It wasn't until two months after that, the Board - under pressure - finally notified the members of the filing. In an attempt to explain the boards’ justification, the HOA President wrote: “I think that you would agree that if a political party is voted into an office, it does not need to follow the previous party’s decisions, regulations, policies, and laws. In fact, I would hope you agree that the voters voted for the new party to have the rules changed.” …  Former President of the Board of Directors, Bluffview Greens Home Owners Association.

Board Members Attempt to Cover-up Blunders ...What Bluffview Greens Board doesn’t want you to know

The above images are a sample of our newly repainted entry gates and fences.  After viewing the photos, HOA Board members adamantly defended the contractor over the serious workmanship issues; and refused to acknowledge that the new paint was applied directly over the old peeling paint, dirt, and rust. This paint needs to be removed. However, now the cost is exponentially greater (estimates are $30,000 to $40,000) to remove the two improperly applied layers of paint, prepare the surface, prime, and paint it right. 


Board Member David Garrett wrote: Minor imperfections notwithstanding, the bare metal is covered and protected.  The risk of catastrophic failure let alone unsightly corrosion is trivial. …it is our opinion that no rational person will conclude that the work poses a "significant cost and liability to the community.”
